Visa refused? Refusal, procedural fairness letter and appeal services

A refusal letter is usually a template with ticked boxes. The officer's real reasoning sits in the GCMS notes. Reapplying without reading them often produces a second refusal, and two refusals are harder to overcome than one. Star Immigration starts every refusal file with the notes, then tells you honestly whether to reply, reapply or challenge.

What is a visa refusal or procedural fairness letter?

A refusal is IRCC's final decision not to approve your application. A procedural fairness letter (PFL) comes before a decision: it tells you the officer has concerns and gives you one chance to answer them. Both deserve a careful response, because both stay on your immigration record.

Refusals must be declared

Every future application asks about past refusals, from any country.

Reasons are often in the notes

The letter gives a summary; GCMS notes give the officer's reasoning.

PFLs are your last chance

A thin reply is usually followed by refusal.

Misrepresentation is serious

A finding under section 40 of IRPA can bar you for five years.

What to do in the first 72 hours after a refusal

Whatever was refused, these steps protect your options.

“I appreciate their advice and the way they work. My work permit was refused but they helped me getting my work permit.”
Rajan Kapoor, Star Immigration client
  1. Note the decision date

Deadlines run from when you received the decision.

  2. Check your status in Canada

If status ended with the refusal, the 90-day restoration window may have started.

  3. Don't reapply yet

A quick second application with the same documents is the most common mistake.

  4. Get the officer's notes

Some refusals include decision notes; otherwise we request GCMS notes.

  5. Choose the remedy

Reconsideration, reapplication, IAD appeal or judicial review.

GCMS notes and ATIP requests

The Global Case Management System records everything the officer wrote: the documents they relied on, the concerns they flagged and the reasoning behind each ticked box. Citizens, PRs and people present in Canada can request their own notes; applicants abroad need a representative in Canada, like Star Immigration, to request them with consent. Notes typically arrive in about 30 days.

Procedural fairness letter responses

We answer each concern separately, with documents, in the order the officer raised them. If evidence can't arrive in time, we ask for an extension in writing before the deadline passes.

Four remedies after a refusal

Reapplication

When the refusal came from missing or weak evidence you can now provide.

Reconsideration request

When there's a clear error, such as an overlooked document.

IAD appeal

For family class sponsorships, removal orders and residency decisions. IAD appeals

Judicial review

Federal Court review, filed by an immigration lawyer we work with.
